1. Description of Service

Connect98 USA, LLC provides a web-based application for managing mobile marketing campaigns including messaging services. The Service is provided on an “AS-IS” and “AS AVAILABLE” basis.

2. Registration & Eligibility

You must be legally able to form a binding contract and provide accurate registration data. Accounts may be suspended for false information.

3. Payment & Fees

You authorize monthly recurring charges and overage fees as agreed. Third-party or carrier increases may be passed through at cost.

4. Privacy

Your information is governed by our Privacy Policy available at Connect98.com/privacy-policy.

5. Acceptable Use & Legal Compliance

You are solely responsible for complying with all federal and state laws including TCPA, CAN-SPAM, FTC, FCC regulations, and CTIA guidelines.

No spam or unauthorized marketing
No unlawful, abusive, or misleading content
No use without proper consent
No impersonation or deceptive practices

TCPA violations may result in statutory damages of $500 per message ($1,500 for willful violations).

6. Downtime & Credits

Limited credits may be issued if downtime exceeds defined monthly thresholds.

7. Refund Policy

Refunds are discretionary and not available for violations or terminated accounts.

8. Indemnification

You agree to defend and indemnify Connect98 USA from claims arising from your use of the Service or violation of law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND.

10. Limitation of Liability

Connect98 USA is not liable for indirect, incidental, or consequential damages.

11. Changes to These Terms

Connect98 USA reserves the right to update, modify, or revise these Terms & Conditions at any time in its sole discretion.

If material changes are made, notice may be provided by email, text message, or by posting the updated Terms on the Service. The “Last Updated” date above will reflect the date of the most recent revisions.

Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.

12. Governing Law

This Agreement and any dispute arising out of or relating to this Agreement or the Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

You and Connect98 USA agree to submit to the exclusive jurisdiction of the state and federal courts located in St. Johns County, Florida.
